West Perth Bylaw
MUNICIPALITY OF WEST PERTH
BYLAW NO. 39-2004
FOR THE REGULATION OF OFF-ROAD VEHICLES
and MOTORIZED SNOW VEHICLES
1.
INTERPRETATION(1) Highway includes a common and public highway, street, avenue, public
lane, parkway, driveway, square, place, bridge, viaduct, or trestle,
designed and intended for or used by the general public for the passage
of vehicles.
(2) Low pressure bearing tire means a wide, balloon-type tire with a
rounded cross section and no distinct shoulder area and that is designed
to operate with inflation pressure of no greater than 70 kpz (10psi);.
(3) Motorized snow vehicle means a self-propelled vehicle designed to be
driven primarily on snow.
(4) Off-road vehicle means an off-road vehicle within the meaning of the
Off-Road Vehicles Act
, R.S.O. 1999, c.12, Sched R.s. 17; 2002, c.17,Sched.F, Table.
2. Subject to the provisions of this by-law, motorized snow vehicles and an
off-road vehicle with three or more wheels and low pressure bearing
tires may be operated on any highway within, and under the jurisdiction
of the Municipality of West Perth.
3. No person shall operate a motorized snow vehicle or an off-road vehicle
with three or more wheels and low pressure tires within the boundaries
of the Mitchell Ward between the hours of 12:00 a.m. and 6 a.m.
4. A motorized snow vehicle or an off-road vehicle shall not be operated
on any sidewalks in the Municipality of West Perth other than for the
purpose of crossing sidewalks when traveling from private property to
the roadway.
5. No person shall operate a motorized snow vehicle or an off-road vehicle
with three or more wheels and low pressure bearing tires in the Mitchell
Ward on, or travel across, that part of Ontario Road between the western
most limit of Wellington Street and the eastern most limit of Blanshard
Street.
6. No person shall operate a motorized snow vehicle or an off-road with
three or more wheels and low pressure bearing tires in any area where a
sign is posted prohibiting such operation.
7. No person shall operate a motorized snow vehicle or an off-road vehicle
with three or more wheels and low pressure bearing tires at a speed
greater than:
(a) 20 kilometres per hour, if the speed limit established for that part
of the highway is not greater than 50 kilometres per hour; or
(b) 50 kilometers per hour, if the speed limit established for that part
of the highway is greater than 50 kilometres per hour.
7. The provisions of this by-law shall be subject to the provisions of the
Highway Traffic Act, R.S.O. 1990, Chap. H8,
and amendments thereto,the
Off-Road Vehicles Act, R.S.O. 1990, C.0.4, and amendments thereto,and the
Motorized Snow Vehicles Act, R.S.O. 1990, c. M. 44, andamendments thereto.
8. Any person found in contravention of this by-law is guilty of an offence
and upon conviction is liable to a fine of $110.00 excluding court costs.
